These Terms of Service (Terms) govern your access to and use of the Tanaw PH website (tanawph.com) and the services offered by Tanaw PH (referred to as Tanaw, we, us, or our), an independent personal scouting, sourcing, and errands service based in Quezon, Bukidnon, Philippines. By accessing or using the website, or by engaging us, you agree to these Terms. If you do not agree, do not use the website or our services.

1. What we are, and what we are not

Tanaw provides independent, on the ground help: we scout land and property, source and check suppliers, inspect places and deals, run errands, and produce photos and video, on request and for a fee.

Tanaw is not a licensed real estate broker, dealer, or salesperson, and does not act as one. We do not sell property, we do not represent buyers or sellers in a brokerage capacity, and we do not earn commissions on any sale. Any listing shown on this website is displayed as a courtesy and for information only. We market and film listings and introduce interested parties as a convenience.

We are not a party to any transaction between you and any owner, seller, supplier, or other third party. Any negotiation, agreement, payment, contract, and transfer is solely between you and that party. All due diligence, verification of title, permits, quality, quantity, legality, and compliance, and all contracts and payments, are your responsibility and that of the other party. We do not negotiate prices, hold funds, handle payments, or close deals.

2. Listings and information

Information on this website, including listings, prices, measurements, features, availability, locations, and descriptions, is provided by owners or suppliers or gathered by us, and is provided on an as is basis without any warranty of accuracy, completeness, availability, legality, or title. Details may be out of date, may change without notice, or may be incorrect. You must independently verify any information before relying on it or entering into any transaction.

3. Our services and fees

Any engagement of our services is by separate agreement between you and us. Our pricing is a fixed price per day for the work, plus the actual travel and related expenses of the job, all agreed before we start. Nothing on this website is a binding offer, and an enquiry does not create a contract. A service engagement exists only once we and you have agreed on it. We may decline any request at our discretion, and we will not perform anything unlawful.

4. No professional advice

Our reports, photos, video, notes, and communications are observations and are provided for your convenience only. They are not legal, financial, investment, tax, engineering, surveying, appraisal, or real estate advice, and are not a substitute for your own professional advisers and independent due diligence. Any decision you make is your own.

5. Assumption of risk

You acknowledge that scouting, inspection, and errands involve real world conditions and that any photo, video, or report reflects conditions only at the time and place observed. We do not guarantee the current or future condition, safety, legality, title, boundaries, value, or suitability of any property, supplier, product, or place. You assume the risk of relying on any information we provide.

6. Your responsibilities

• Provide accurate and lawful information when you contact or engage us.
• Use the website and our services only for lawful purposes and not to request anything illegal or harmful.
• Do not misuse, disrupt, copy, scrape, or attempt to gain unauthorised access to the website.
• You are responsible for your own dealings, agreements, and payments with any owner, seller, supplier, or third party.

7. Third party links and advertisements

The website may link to, or display advertisements for, third party websites and businesses, including sponsors. We do not control, endorse, or take responsibility for any third party, their content, or their products or services. Any dealings you have with a third party are solely between you and that party, and at your own risk.

8. Intellectual property

The website and its content, including text, layout, graphics, logos, the Tanaw name, and the photos and video we produce, are owned by or licensed to Tanaw and are protected by law. You may not copy, reproduce, distribute, or use them without our prior written permission.

To the fullest extent permitted by law, the website and our services are provided on an as is and as available basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non infringement. We do not warrant that the website will be uninterrupted, error free, secure, or free of harmful components, or that any information, listing, owner, seller, supplier, or outcome will meet your expectations.

10. Limitation of liability

To the fullest extent permitted by law, Tanaw and its owners, personnel, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, revenue, data, opportunity, or goodwill, arising out of or relating to your use of the website or our services, any listing or information, any introduction, or any transaction or dealing with any owner, seller, supplier, or third party, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the website or our services will not exceed the amount you actually paid us for the specific service that gave rise to the claim, or, if you have not paid us, one thousand Philippine pesos (PHP 1,000).

11. Indemnification

You agree to indemnify, defend, and hold harmless Tanaw and its owners, personnel, and representatives from and against any claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or relating to your use of the website or our services, your dealings or transactions with any third party, your breach of these Terms, or your violation of any law or the rights of any person.

12. Privacy

Your use of the website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes and availability

We may change, suspend, or discontinue the website or any service, and we may update these Terms, at any time. Updated Terms will be posted on this page with a new date, and your continued use after they are posted means you accept them.

14. Governing law and venue

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law rules. You agree that any dispute arising out of or relating to these Terms, the website, or our services will be brought exclusively before the proper courts of Bukidnon, Philippines. Nothing in these Terms removes any right you have under mandatory Philippine consumer protection or data privacy law that cannot be waived.

15. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the website and supersede any prior understanding on that subject.
